These Terms govern your use of beyondscaleco.com (the "Site") operated by BeyondScale ("we", "us"). By using the Site or submitting an application you agree to these Terms.
The Site describes our done-for-you local search marketing services and lets you apply for a strategy call. Nothing on the Site is an offer to provide services. Any engagement is governed by a separate written agreement that we both sign.
Submitting an application doesn't obligate you to buy anything or us to work with you. We review applications and may decline for any lawful reason, including that we already serve a competitor in your trade and area. Booked calls are free. If you can't make a call, please reschedule using the link in your confirmation email.
Case studies, screenshots, testimonials and figures on the Site are real examples from specific clients. They are not a promise that you will get the same results. Results depend on your market, competition, reviews, website, how quickly you answer calls, and other things outside our control. We make no guarantee of rankings, call volume, revenue or return on investment, except the specific written guarantee in a signed client agreement.
The guarantee described on the Site is a summary. Its exact terms — the key performance indicator (KPI), the 90-day start date, your obligations (access within 48 hours, answering leads, approving changes within 2 business days) and the remedy (up to 90 additional days of work at no charge) — are set out in the client agreement, which controls if there is any difference.
By checking the consent box on the application you agree to receive calls, texts and emails from us as described in our Privacy Policy. You can opt out at any time by replying STOP to a text or emailing support@beyondscaleco.com.
Don't submit false information, impersonate anyone, scrape the Site, probe its security, or use it for anything unlawful. We may block access for any violation.
The Site's content, design and brand are ours or licensed to us. Client logos and screenshots are used with permission. You may not copy or reuse them without written consent.
Scheduling is provided by Calendly and video by Cloudflare Stream, each under their own terms. We aren't responsible for third-party services.
The Site is provided "as is." To the fullest extent allowed by law we disclaim all warranties, and our total liability arising out of your use of the Site will not exceed $100. We are not liable for indirect, incidental or consequential damages.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located there. [VERIFY state]
